What is physical custody?
Physical custody is maintained by the parent who has actual physical custody over the child. This includes maintaining a place of residence that is conducive to a child experiencing a happy, health life. The courts take physical custody very seriously, and evaluate each parent thoroughly before handing down its decision.
Emotional and financial stability of the parent is taken into consideration, as is the current relationship with the children and the history of that relationship. The court considers all of these factors, and more, before awarding physical custody.
The trend these days is to award joint physical custody because studies show children benefit from having contact with both parents.
